Bayless of Princeton, West Virginia obtained a $2,222,847.87 verdict against Orthopedic Surgeon Walid Azzo, M.D. in the Circuit Court of Mercer Counter, West Virginia. The injured victim, Willie Havens, was treated with a short leg cast by Dr. Azzo for a simple non-displaced fracture of his 5th metatarsal, a bone of the foot.
When Mr. Havens retuned to Dr. Azzo’s office for a follow-up appointment, he complained of severe pain and swelling of his leg and calf while in the cast. Dr. Azzo removed the cast and told Mr. Havens that his pain was from a “Charlie-horse” and that he was not to worry. Mr. Havens ended up having a large and extensive Deep Vein Thrombosis (DVT), a blood clot in his leg. After the DVT was finally discovered, Mr. Havens received treatment and thereafter suffered from Post Thrombotic Syndrome (PTS), a condition where the valves in his deep leg veins were destroyed by the clot. Post Thrombotic Syndrome (PTS) is a painful condition that causes the leg to swell because blood pools in the leg.
The jury awarded Mr. Havens his medical expenses and lost wages totalizing $222,847.87 and pain and suffering and loss of enjoyment of life damages of $2,000,000.00.
