What Prompted the Filing of the Suit?
In October of 2020, Brian Pankey underwent robotic lysis of adhesions, robotic takedown of end colostomy with resection of ostomy, small bowel resection, and resection of rectosigmoid junction for history of diverticulitis with end colostomy. Four months later, he had no arms or legs.
What happened to create this drastic turn for the worse?
Following his end colostomy surgery, Mr. Pankey had a series of abnormal post-operative labs and vital signs. A CT scan revealed the presence of a large hematoma. His surgeon discharged him despite his abnormal findings.
Within a day of being at home, Mr. Pankey found himself returning to the emergency room in extreme distress. After more delays, surgery revealed that the hematoma was infected with MRSA. Large doses of pressors were administered to keep Mr. Pankey alive which caused a lack of blood flow to all his extremities, leading to all his limbs being amputated. Mr. Pankey was owed a duty of care by his physician.
In personal injury cases, four elements of negligence must be proven, including that the defendant owed the plaintiff a duty of care and violated that duty. Our attorneys fought to prove that this doctor failed his patient a duty of care by prematurely discharging him despite abnormal lab findings. Because of this negligence, Mr. Pankey was left with permanent scarring and disfigurement, as well as lifetime trauma and emotional turmoil.
